
TERMS & CONDITIONS
At Maintech Automotive, we are committed to providing transparent, reliable, and high-quality automotive services. The following Terms & Conditions outline our policies regarding repairs, diagnostics, warranties, and customer responsibilities. By engaging our services, you acknowledge and agree to these terms. We encourage you to review them carefully and contact us if you have any questions.
TERMS & CONDITIONS OF SERVICE
1. Authorisation to Repair
By signing or approving services (written, digital, or verbal), the customer authorises Maintech Automotive to inspect, diagnose, repair, and/or maintain the vehicle described. The customer confirms they are the legal owner of the vehicle or have authority to approve repairs. Must present a form of identification to prove ownership of the vehicle. Example car registration and licence.
2. Estimates
All estimates are based on initial inspections and information provided by the customer. Estimates are not fixed prices. If additional faults or repairs are identified during the service, the customer will be contacted for approval before any additional work is carried out.
3. Diagnosis & Vehicle Condition
Vehicle diagnosis is performed using reasonable care and skill. Due to the complex nature of motor vehicles, Maintech Automotive cannot guarantee that all faults will be identified or that future issues will not occur. We are not responsible for unrelated or pre-existing conditions discovered after repairs are completed.
4. Parts & Materials
Unless otherwise agreed:

Replacement parts may be new, second hand, or reconditioned

Removed parts will be disposed unless the customer requests them prior to service

Maintech Automotive strongly recommends the use of brand-new parts for reliability and warranty purposes
5. Customer-Supplied Parts
Maintech Automotive may agree to install parts supplied by the customer; however:

No warranty is provided on customer-supplied parts

Maintech Automotive is not responsible for defects, failures, incorrect parts, or compatibility issues

Labour associated with installing customer-supplied parts is not covered under warranty

Any additional labour required due to incorrect or faulty customer-supplied parts will be charged to the customer
6. Warranty
Maintech Automotive provides a warranty on parts supplied by us and labour performed for a period of:
6 months or 10,000 kilometres (whichever occurs first)
This warranty does not cover:

Normal wear and tear
-
Damage caused by misuse, neglect, accidents, or modifications

Failures caused by unrelated or pre-existing vehicle conditions
-
Customer-supplied parts
-
Vehicles used for racing, commercial abuse, or towing beyond manufacturer limits
Parts warranties are subject to manufacturer terms and conditions.
7. Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts, or modifies any rights or remedies available under the Australian Consumer Law. Customers are entitled to guarantees that services will be provided with due care and skill and that parts will be fit for purpose.
8. Limitation of Liability
To the extent permitted by law, Maintech Automotive is not liable for:

Loss or damage resulting from pre-existing vehicle conditions

Electrical or electronic failures, hidden defects, or rust-related issues

Delays caused by parts availability, suppliers, or events beyond our control

Loss or damage to personal items left in the vehicle, unless caused by our negligence
Nothing in this clause excludes, restricts or modifies any rights or remedies under the Australian Consumer Law.
To the extent permitted by law, our liability for breach of any non-excludable guarantee is limited to the re-supply of the services or the payment of the cost of having the services supplied again.
9. Test Drives & Vehicle Operation
The customer authorises Maintech Automotive employees to operate the vehicle on public or private roads as necessary for testing, diagnosis, and quality control purposes.
10. Payment Terms
Payment is due in full upon completion of services unless otherwise agreed in writing. Maintech Automotive reserves the right to retain possession of the vehicle until payment for authorised services is received, in accordance with applicable laws.
11. Storage Fees
Vehicles not collected within 3 business days after notification of completion may incur storage fees of $12 per day, unless otherwise agreed.
12. Abandoned Vehicles
Vehicles left unpaid or uncollected may be deemed abandoned and dealt with in accordance with Queensland laws, including recovery of costs through sale or disposal.
13. Indemnity
The customer agrees to indemnify and hold harmless Maintech Automotive from any claims, losses or damages arising from the vehicle’s pre-existing condition, misuse, or failures not related to the services performed, except to the extent caused by our negligence or breach of the Australian Consumer Law.
14. Governing Law
These Terms & Conditions are governed by the laws of Queensland, Australia.
15. Acceptance
By approving repairs or services, the customer acknowledges they have read, understood, and agreed to these Terms & Conditions.

Maintech Automotive may update these Terms & Conditions from time to time. Updated versions will be available at the workshop and on our website.
